ELAMUS PLUSS RENTAL CONDITIONS

1. General provisions

1.1. In these rental terms and conditions (hereinafter referred to as the Terms), the Lessor is Elamus Pluss OÜ or MTÜ Elamus Pluss, and the Lessee is a natural or legal person who rents the property (hereinafter referred to as the Rental Property) owned or mediated by Elamus Pluss OÜ or MTÜ Elamus Pluss.

1.2. A rental agreement is an agreement concluded between the Lessor and the Lessee, under which the Lessor undertakes to provide the Lessee with the item(s) to be rented for temporary use and the Lessee undertakes to pay a fee for it. The Terms and Conditions are an integral part of the Rental Agreement.

1.3. The rental agreement is deemed to be concluded from the moment the Renter has paid the advance payment for the rental service.

1.4. By paying the cost of the rental service (including the advance payment), the Renter confirms that he has read the terms and conditions of the Rental Agreement and agrees with them.

1.5. The Lessor is not liable for any property, physical or mental damage to the Lessee or third parties that may occur during the use of the Leased Property. 

2. Issuance and return of rental property

2.1. The basis for renting the Leased Property is an invoice issued by the Lessor, which includes a precise list of the Leased Property, the length of the lease period and its cost.

2.2. The renter shall pay the rental amount in full as an advance payment based on the invoice.

2.3. The Lessee is obliged to return the Leased Property no later than the last day of the rental period specified in the invoice to the address Kivi 59, Tartu, 51009, Tartumaa, Estonia, unless otherwise agreed with the Lessor.

2.4. If the Lessee needs to return the property later than the deadline agreed in the invoice, the Lessee is obliged to immediately notify the Lessor. If the leased property is not returned by the deadline, the Lessor has the right to demand a contractual penalty for the late period, which is equal to double the rental fee.

2.5. The Lessor shall submit an invoice to the Lessee for days overdue or for lost, damaged or destroyed Rental Property, which shall be payable immediately.

2.6. If the Renter cancels the order less than 48 hours before the start of the rental period, the rental fee is not refundable.

2.7. The Rental Equipment must be returned by the Renter personally or through a person authorized by him/her. In both cases, the Renter is responsible for the timely return and condition of the Rental Equipment.

3. The lessee is obliged to:

3.1. use the Rental Property prudently and for its intended purpose;

3.2. return the Rental Property clean and in the same condition as when it was issued (excluding normal wear and tear);

3.3. notify the Lessor as soon as possible if the Leased Property is lost, damaged or destroyed;

3.4. In the event of loss or destruction of the Rental Property, compensate the Lessor for the damage caused to the Lessor in the amount of the value of the Rental Property (i.e. "replacement price") indicated on the website www.elamuspluss.ee, whereby the maximum amount of compensation is the market value of the product when new, together with additional delivery, administrative and time costs necessary to replace the rental item;

3.5. compensate the Lessor for repair costs in the event of damage to the property;

3.6. check the condition of the Rental Equipment immediately upon receipt and notify the Lessor thereof. Later claims will not be considered.

4. The tenant is prohibited from:

4.1. make the Leased Property available to third parties and in turn lease, sell or otherwise transfer it;

4.2. independently carry out or order repairs to the Rental Property from third parties, unless this has been previously agreed with the Lessor.

5. The lessor is obliged to:

5.1. notify the Lessee within a reasonable time if, after returning the Leased Property, it is determined that the Leased Property has become unusable or that there has been a significant decrease in the value of the Leased Property that is not due to normal wear and tear;

5.2. reduce the rental fee or waive it in favor of the Lessee if it becomes apparent that the Leased Property issued to the Lessee was either partially or completely unusable.

6. The lessor has the right:

6.1. establish a deposit for the Leased Asset, which will be returned after the Lessor has received and inspected the leased equipment. If necessary, the costs of repairing or cleaning the Leased Asset or a contractual penalty for exceeding the return deadline will be deducted from the deposit. The deduction does not include costs associated with normal wear and tear of the Leased Asset;

6.2. terminate the Rental Agreement immediately if it becomes apparent that the Renter has provided false information, does not pay the rental fee on time, does not ensure the preservation of the Rental Equipment in the rented form, uses the Rental Equipment in violation of the Terms and Conditions or otherwise violates the Rental Agreement. In the event of termination of the Rental Agreement, the Renter is obliged to immediately return the Rental Equipment.

7. Resolving disagreements

7.1. Disagreements arising from the interpretation of the rental terms and conditions shall be resolved primarily through negotiations between the Lessor and the Renter. If the dispute or disagreement cannot be resolved through negotiations, the consumer has the right to contact the Consumer Protection and Technical Regulatory Authority at Sõle 23A, 10614 Tallinn; e-mail info@ttja.ee.

7.2. Disputes that cannot be resolved out of court will be resolved in the court of the consumer's place of residence.

8. Personal data

8.1. The Lessor processes the Lessee's personal data for the performance of the Lease Agreement in accordance with the relevant data protection laws and Elamus Pluss privacy policy with the defined.

8.2. By entering into the rental agreement, the Lessee agrees Elamus Pluss privacy policy.
