Standard information sheet for package travel contracts
The set of travel services offered to you constitutes a package within the meaning of Directive (EU) 2015/2302. You therefore have all the rights that a traveller has under EU law in the case of a package travel. The operator Elamus Pluss The OÜ is fully responsible for the proper provision of the package travel services as a whole. In addition, the law requires that the entrepreneur Elamus Pluss The OÜ is a guarantee to pay back your payments if it is unable to fulfill its obligations due to solvency and, if the package tour includes passenger transport, to ensure your return journey to the place of departure or another agreed place.
Key rights under Directive (EU) 2015/2302:
1) The traveller receives all important information about the package travel before concluding the package travel contract.
2) At least one economic operator is always responsible for the proper provision of all travel services included in the contract.
3) The passenger is given an emergency telephone number or contact point details through which he can contact the tour operator or intermediary.
4) The traveler may transfer the package tour to another person upon reasonable notice and for a possible additional fee.
5) The price of the package may only be increased if specific costs (e.g. fuel prices) increase and if this is expressly stipulated in the contract and in any case not later than 20 days before the start of the package. If the price increase exceeds eight percent of the cost of the package, the traveller may withdraw from the contract. If the tour operator reserves the right to increase the price of the package, the traveller is entitled to a reduction in the price of the package if the relevant costs decrease.
6) The traveller may withdraw from the contract without compensation and receive a full refund of all amounts paid if a significant part of the package other than the travel fee is significantly modified. If the package is cancelled by the operator responsible for the package before the start of the package, the traveller is entitled to a refund and, where appropriate, compensation.
7) The traveller may withdraw from the contract before the start of the package travel without paying compensation in exceptional cases, for example if there are serious security problems at the destination that may affect the package travel.
8) In addition, the traveller may withdraw from the contract at any time before the start of the package travel, subject to payment of appropriate and reasonable compensation.
9) If, after the start of the package, it is not possible to provide a significant part of the package travel services in the agreed manner, other suitable services must be offered to the traveller at no additional cost. If the services are not provided in accordance with the contract and the non-conformity significantly affects the provision of the package travel services and the tour operator has not remedied the non-conformity, the traveller may cancel the package travel contract without paying compensation.
10) The passenger has the right to a reduction in the travel fee and/or compensation for damage if travel services are not provided or are provided improperly.
11) The tour operator must provide assistance if the traveler gets into difficulty.
(12) If the tour operator or, in some Member States, the retailer is unable to fulfil his obligations under the contract due to insolvency, the sums paid shall be refunded. If it becomes apparent after the start of the package that the tour operator or, where applicable, the retailer is unable to fulfil his obligations under the contract due to insolvency, and the package includes the carriage of passengers, the passenger shall be transported to the place of departure or another agreed place.
