MTÜ ELAMUS PLUSS MOUNTAINEERING TRAINING CONDITIONS
1. General provisions
1.1 MTÜ Elamus Pluss The training conditions agreement for the Alpinism Training (hereinafter Alpinism Training) (hereinafter Training Conditions) determines the relations, rights and obligations, and rules of conduct between Alpinism Training and the Alpinism Training trainer (hereinafter Trainer). The majority of training takes place in the facilities of the Climbing Factory (Tartu) and the Ministry of Climbing (Tallinn), therefore the internal rules established by the respective sports halls (hereinafter Internal Rules) are an integral part of the Training Conditions. In addition, the Alpinism Training liability form/consent form (hereinafter Liability Form), which can be found on the website www.elamuspluss.ee/terms.
1.2. Before starting the training sessions, the member must read and agree to the Training Terms. The Trainee confirms their agreement to the Training Terms with a signature. Agreeing to the Training Terms is considered the conclusion of a training agreement between the Alpinism Training and the Trainee.
1.3. A Trainee under the age of 18 must have a written and signed consent from a parent or legal guardian in order to participate in the training sessions. By signing the consent, the parent or guardian agrees to the Training Terms and shares joint responsibility with the Trainee for fulfilling all obligations set out in the Training Terms towards the Alpinism Training.
1.4. The Training Terms apply indefinitely to all individuals for as long as they participate in the Alpinism Training sessions or wish to be associated with the Alpinism Training in any way.
2. Training organization
2.1. Training sessions take place in designated training groups according to a set schedule. In addition, the Alpinism Training has the right to organize additional training sessions outside the regular schedule and to offer private training sessions to those interested. The schedule (i.e., timetable) is published on the Elamus Pluss website www.elamuspluss.eePrivate training sessions are arranged individually between the coach and the Trainee. The Alpinism Training reserves the right to make changes to the schedule, as well as to the timing of additional and private training sessions, without prior notice, informing the Trainees as soon as possible via the Elamus Pluss website, email, or social media channels.
2.2 To participate in the training, you must complete a registration form on Elamus Pluss website www.elamuspluss.ee or to contact a representative or the head coach of the Alpinism Training by other means. Participation in training sessions requires written or verbal consent and confirmation from a representative or the head coach of the Alpinism Training
2.3 Alpinism training is based on planned and regular training in three training groups:
2.3.1 Basic course or initial preparation, where the main focus of training is to provide basic technical skills in the relevant sport and basic physical training.
2.3.2 A continuation course, where the topics covered in the basic course are repeated and further developed at a higher level of technical and physical skills.
2.3.3 Advanced training, where existing skills are improved and developed towards mastery.
2.4 The trainer can train in a training group that corresponds to his/her level. The basic course is suitable for a trainer with no previous training experience or with little experience in mountaineering. Successful completion of the basic course is considered to be the completion of at least 2/3 of the basic course training and/or the acquisition of the skills taught, as assessed by the Alpinism training provider. The participant in the advanced course must have completed the basic course or have the corresponding technical skills and physical ability. The advanced course is a further development of the skills and topics covered in the basic course. Trainers with in-depth knowledge and skills in mountaineering can train in advanced training. The decision on training in training groups that correspond to the level is made by the Alpinism training representative or head trainer.
2.5 You cannot join the basic or advanced Alpinism training course after the course has started, unless otherwise expressly agreed with the Alpinism training representative or head coach.
2.6. Any issues that arise during training sessions must be reported immediately to a representative or coach of the Alpinism Training.
2.7. Representatives and coaches of the Alpinism Training have the right to deny Trainees access to training sessions if they observe a risk to the health of the Trainee or third parties, or if the member does not comply with the Training Terms. In such cases, the participation fee will not be refunded or compensated.
3. Training fees
3.1 Before starting training, a membership fee must be paid, which may be in the form of a monthly pass, a one-time pass or a course fee (hereinafter referred to as the Membership Fee). The representative or coach of Alpinism Training has the right to refuse to allow a person who has not paid the membership fee to participate in the training.
3.2 The membership fee price is set by the MTÜ Elamus Pluss. The price list can be found on Elamus Pluss website www.elamuspluss.ee. Elamus Pluss has the right to establish discounts, organise campaigns, grant membership fee exemptions to Trainers (including issuing training scholarships) and change them at its sole discretion. Elamus Pluss reserves the right to change the price list at any time without prior notice.
3.3 Membership fee must be paid to the MTÜ Elamus Pluss. When paying the membership fee by bank transfer to the MTÜ Elamus Pluss The account must clearly state the Trainer's first and last name, training group, and the start date of the Membership Fee (monthly pass or course fee) or the period of use (one-time pass). If the transfer does not indicate the start date or period of use of the Membership Fee, the membership fee will become effective from the date of the transfer or the date of the first training session for which the membership fee has not been received.
3.4 The membership fee is non-refundable.
3.5. The membership fee is not suspended or postponed. As an exception, the Trainee has the right to apply for a suspension of the membership fee (excluding single-entry passes) by submitting a written request, in cases where the Trainee is unable to participate in training due to illness, injury, or other unforeseen circumstances. In such cases, the minimum suspension period is two weeks. Before returning to training, the Trainee is obligated to notify a representative or the head coach of the Alpinism Training in writing.
3.5 The membership fee is valid only for the paid period/visit and ends on the date following the period. When extending the membership fee, the new membership fee start period is considered to be the day following the end of the previous period, unless another date is specified in the explanation of the payment order. Membership status is personal and only applies to the person for whom the membership fee has been paid. If necessary, the Sports Club has the right to request the presentation of an identity document to identify the Trainer.
4. Training equipment and tools
4.1 Training equipment and tools, climbing walls, climbing dummies and other property used in mountaineering training must be used prudently and carefully.
4.2. The Trainee is obligated to immediately inform a representative or the head coach of the Alpinism Training of any property damage, including damage to, loss of, theft of, or any similar incident involving training equipment or gear.
4.3 The organizer of mountaineering training is an MTÜ Elamus Pluss and the administrator of the climbing wall or sports facilities has the right to demand full compensation for any property damage caused. This does not include natural wear and tear of training equipment and facilities.
4.4. The Trainee is obligated to ensure the safety of the training equipment and gear used in the Alpinism Training before using them. The Trainee must immediately notify a representative or coach of the Alpinism Training of any damaged or unsafe training equipment or conditions.
4.5 MTÜ Elamus Pluss, the Climbing Factory and the Ministry of Climbing and their representatives are not responsible for the Trainer's personal property.
4. Other conditions
4.1 Participation in mountaineering training is entirely at the Trainer's own risk. MTÜ Elamus Pluss, the Climbing Factory, the Ministry of Climbing, or representatives and trainers of the Alpinism Training are not liable for the possible consequences of the Trainer's actions or inaction, which may result in damage to health or property. The exemption from liability does not apply in the event of negligence or intentional damage caused by the Alpinism Training provider.
4.2 Before coming to training, the trainer must be aware of his/her health condition and be convinced that physical activity and training are safe and indicated for him/her. If necessary, a doctor must be consulted before starting training. MTÜ Elamus Pluss, Climbing Factory, Ministry of Climbing and their representatives/trainers are not responsible for any trauma, injury, illness or the Trainer's health condition during Alpinism Training.
4.3. Training must comprehensively support the Trainee’s mental, physical, and social well-being and health. If there is any suspicion that training in the Alpinism Training poses a risk to the health or well-being of the Trainee or third parties, a representative or coach of the Alpinism Training has the right to deny the Trainee participation in the training and to recommend consulting a doctor or other specialist. If the condition does not improve significantly, the Alpinism Training may prohibit the Trainee from participating in training sessions indefinitely; in such cases, the participation fee will not be refunded or compensated.
4.4. Children under the age of 16 may be present in the training area during training sessions only under the supervision and responsibility of a parent. Children are not allowed to be in the training area during training if their presence endangers or disrupts the Trainees, the training activities, and/or the child's own health or well-being.
4.5. The Alpinism Training may create photo and video materials of the Trainee in connection with the training sessions and use and distribute them at its sole discretion.
4.6. Trainees in the Alpinism Training are expected at all times to be polite, tolerant, and considerate towards themselves and others, to represent the values and beliefs of the Alpinism Training, to respect healthy lifestyles, to promote alpinism and sports, and to do everything possible to maintain the good name and reputation of the Alpinism Training. In cases of violation of the house rules, non-compliance with the Training Terms, inappropriate behavior, damage to the reputation of the Alpinism Training, or significant breach of its beliefs, a representative or coach of the Alpinism Training has the right to deny the Trainee access to training sessions or to remove the Trainee from the sessions. Denial of access to training sessions for these reasons shall be considered a unilateral termination and conclusion of the training agreement. No refund or compensation will be made for the participation fee in the event of unilateral termination of the training agreement.
4.7. The Trainee in the Alpinism Training keeps themselves informed about the activities of the Alpinism Training through the website, email list, and/or social media channels.
5. Personal data
5.1. MTÜ Elamus Pluss processes the Trainee’s personal data for the purpose of fulfilling the training agreement in accordance with the applicable data protection laws and Elamus Pluss’s. privacy policy.
5.2 By entering into a training contract, the Trainer agrees Elamus Pluss privacy policy.
